USCIS Responds to Preliminary Injunction of Fee Rule

September 29, 2020 – USCIS's filing fee adjustments set to go into effect October 2, 2020, have been enjoined by U.S. District Court for the Northern District of California Judge Jeffrey S. White’s motion for a nationwide preliminary injunction on September 29th.

Clients who complete filings prior to the injunction being stayed will be able to circumvent the fee adjustments originally set to take effect on October 2, 2020.

Original October 2, 2020 filing fee adjustments:

  •  I-526: $4,010 (up from $3,675);
  •  I-829: $3,900 (up from $3,750)

The filing fee adjustments help USCIS to cover increased adjudication naturalization costs , as well as hopefully reduce processing times. For USCIS the final rule is necessary for the continuation of effective operations from a financial standpoint, as a fee-funded agency.

While the rule is preliminarily enjoined, USCIS will continue to accept USCIS forms with the current editions and current fees.
