Only China Impacted by IPO Change in I-526 Processing Order

Friday, March 13, 2020 - Sarah Kendall, Chief of the Immigrant Investor Program Office (IPO), U.S. Citizenship and Immigration Services (USCIS) announced today, during the EB-5 Immigrant Investor Program: Public Engagement, that USCIS will use Visa Bulletin: Chart B -Dates for Filing of Employment-Based Visa Applications when making a determination on the prioritization of petitions associated with individuals from countries where visas are currently available. As of the April Visa Bulletin, all countries with the exception of China are current on Chart B. USCIS will assess visa availability on a monthly basis and plans to report processing times similarly to other categories currently subject to a visa-availability agency adjudications process in cap-subject categories.

This means only China will likely be impacted by IPO’s change from a from a first-in, first-out basis to a visa availability approach, announced January 29, 2020. You can read more about that change here: https://www.firstpathway.com/blog/new-changes-form-i-526-brings-fairness-visa-allocations
