New Cutoff Date for EB-5 Vietnam

The United States Citizenship and Immigration Services (USCIS) announced earlier this month that due to high demand, a cutoff date of July 22, 2014 has been applied for May 2018 to Vietnamese EB-5 applications.Congress sets limits on the number of immigrant visas that can be issued in a year. The EB-5 immigrant investor program is allotted approximately 10,000 immigrant visas annually. Additionally, each country in the category is limited to 7% of the visas. For applicants from countries that have exceeded the 7% allowance, a wait-list is applied. However, countries may receive additional visas if there are unused visas.Before the May 2018 Visa Bulletin, the EB-5 visa category for nationals of all countries except for Mainland China was current. It is also important to note the Department of State has made it known that:Continued heavy applicant demand will result in the Vietnam Employment Fifth preference (EB-5) category reaching the per-country annual limit during April. As a result it has been necessary to impose a final action date on this preference for the month of May to control number use for the remainder of the fiscal year.  It can be expected that the Vietnam Employment Fifth preference category will remain subject to a final action date for the foreseeable future.
