July Visa Bulletin Reveals First Time Final Action Dates for India

Monday, June 17, 2019 - The U.S. Department of State, Bureau of Consular Affairs has released the July 2019 Visa Bulletin. The bulletin revealed unchanged final action dates (for the EB-5 Regional Center Program) of October 1, 2014 for Mainland-China applications and October 1, 2016 for Vietnam applicants.

Most importantly, the bulletin revealed that India will be subject to a final action date of May 1, 2017 come July 2019. This is the first time in the EB-5 program history that India has been subject to a final action date. The industry has been anticipating the imposition of a final action date for the India market since the June 2019 Visa Bulletin. In the June bulletin, the Department of State had advised that India was likely to reach its per-country annual limit during July.

The date for filing remains current which means applicants can still continue to file their DS-260 Immigrant Visa Application and I-485 Application to Register Permanent Residence.

For August, both countries (Vietnam and India) will become subject to the same final action date which applies to China-mainland born Employment Fifth preference (E5) applicants, and they will be for the remainder of the fiscal year.
 
Such action will only be temporary, with the E5 date for each advancing for October, the first month of fiscal year 2020, as follows:
India:  Most likely advancing to the summer or fall of 2017.
Vietnam: Most likely advancing to the fall or early winter of 2016.
