EB-5 Regulatory Update

On October 17, 2018, the Trump Administration released the Fall 2018 Unified Regulatory Agenda. The Agenda provided updated timelines for existing regulations including a new date for the "EB-5 Immigrant Investor Modernization" regulation to move to Final Rule on 11/00/2018 which has advanced from 08/00/2018. The below Statement of Need provides more information on Final Stage Rule; EB-5 Immigrant Investor Program Modernization:

In the January 2017 NPRM, DHS proposed changes including raising the minimum investment amount from $500,000 to $1.35 million; allowing certain EB-5 petitioners to retain their original priority date; changing the designation process for targeted employment areas; and other miscellaneous changes to filing and interview processes.

With an increase in the minimum investment amount and TEA limitations on the horizon, FirstPathway Partners encourages investors to move quickly with their application to make sure they can continue to take advantage of the comparatively low investment amount.
